Not many people love the idea of paperwork—it can be quite tedious and hassling. However, having a nanny agreement contract is an essential type of paperwork for both you and your nanny. A nanny agreement contract is a written contract that formalizes the deal and the terms and conditions that you have set for your nanny.

Nanny contracts are essential in order to provide a clear outline of the conditions that are necessary to ensure a healthy and productive relationship between you and your nanny. Nanny contracts also reduces the confusion pertaining to your nanny’s responsibilities and privileges and minimizes the possibility of a dispute. Hiring a nanny can involve many different details that you need to think about and mutually agree on. Your nanny contract serves as a formal document that acknowledges you as an employer and your nanny as your employee. Below is a list of items that you essentially need to incorporate into your nanny contract:

Work Hours

You will have to first establish if the nanny is going to be staying in or living out. Once you have figured that out, the next thing to indicate is if the nanny is working full-time or part-time, the time she needs to come in for work, the number of days in a week she is required to work, and if she can take breaks on workdays.

Work Responsibilities

This is another important aspect of a nanny contract. Some nannies are primarily hired to take care of children while others have added responsibilities such as cooking, cleaning, and doing the laundry. Make sure all work obligations are indicated in the contract as well as emergency contingencies like what to do when a child is ill.

Compensation and Benefits

Most nannies are paid on an hourly basis and rates can sometimes differ if their shift is on a day schedule, a night schedule, holidays, or weekends. Pay schedules, overtime, benefits insurances, and taxes should also be stated in the contract. Make sure you are paying your nanny at least the minimum wage.

Terms of Transportation

Will the nanny be given a car as a means of transportation? Will she be reimbursed for gas and maintenance expenses or will she have to rely on public transportation? These terms have to be tackled in the contract as well.

Nondisclosure and Confidentiality Clauses

Your contract will also need to include a clause that ensures you that your nanny does not share or divulge information about your family’s internal affairs, personal, medical, career, and financial information to others.

Rules pertaining to the use of social media such as posting pictures of her and your kids or mentioning you or them online must also be well-defined in the contract to give your nanny a heads-up.

Agreement contracts are important in any employer and employee relationship or a client and service provider transaction. You can also see our Construction Contractor Agreements and Subcontractor Agreements for other agreement contract samples.
