You must be able to use a “prescribed form” especially when you would enter into a written rental agreement. You may even include those terms and conditions that are not placed in the form. You just have to make sure that those items you are placing is not prohibited by the law. Do not include those terms that will eventually take almost all the rights and responsibilities that are provided to you and the tenant. Different Types of Residential Rental Agreement
- Short fixed-term agreement – this can in a form of a verbal or written and may take up to 6 to 12 months or 5 years maximum. If a short fixed-term agreement ends and the tenant still choose to stay in the premises without having to sign an agreement, it will eventually turn into a month to month or periodic agreement.
- Long fixed-term agreement – this type of residential rental agreement usually takes up to 5 years or so. Some tenants might choose being in this rental agreement because it is more secured and stable. Long term agreements must be written. If the renter cannot finish the agreement at any time, he or she must give the rental provider a 28 days’ notice to avoid paying a penalty. If a long fixed-term agreement ends and the tenant still choose to stay in the premises without having to sign an agreement, it will eventually turn into a periodic agreement.
- Periodic agreement – these are considered to be the month-to-month agreement in which the tenant does not have to follow an end date.
