Separation between Business Partners

They say that when you choose a business partner, you should be even more particular and picky than when you are choosing a life partner. Your business partner is someone who would play a significant role in the ownership and management of your company.

Business Partnership Agreements are dissolved for a variety of reasons like personal disagreements between the partners, a significant change in life like relocation or the death of a family member, or different views of the direction the company should head to. A partnership dissolution agreement is necessary if there was no partnership agreement to begin with or it did not provide the terms for what happens in the event of a separation. When signing or drafting a business separation agreement, take note of the following:

  • final distribution of the assets and liabilities,

  • how much the company will pay you in exchange of you surrendering ownership and how you will be paid, and

  • indemnity to make sure you will not be involved in future lawsuits or debts the company might incur.

Separation Between Spouses

Whether or not to give up on a marriage or give it another chance is one of the hardest decisions you’d ever have to make. Deciding that the person loved beyond you thought you were capable of loving is no longer the person you want to wake up next to every morning is perhaps the most heartbreaking decision. However difficult it was to make, sometimes, it is necessary and is to everyone’s best interest. A Marriage Separation Agreement is used if

  • you and your spouse have decided to separate and need to agree on how to divide your assets and properties, or

  • you and your spouse are considering a divorce and would like to separate legally before making any final decisions

Being legally separated still is not necessarily faster or cheaper than getting a divorce or an annulment. Being legally separated still means that you and your partner are married. It is best to consult a lawyer before making any official move.

Separation Between Employment and Employer

There are short-term employees who don’t stay long enough to know everyone’s names while there too are long-term employees who come to know the company like the back of their hands. However, no matter long-term or short, for companies, employees usually come and go. And due to this, Standard Employment Agreements usually include employment termination clauses that cover

  • when an employee becomes a candidate for termination;

  • what paperwork are necessary should the employee voluntary leave the company;

  • liabilities, NDAs, and noncompete agreements; and

  • severance pays, if applicable, and last pays.
