A tenant is the person being referred as someone who is an occupier of a rental property or leasehold state to which they rent from a landlord. Tenancy, by definition, is the agreement made between the tenant and the landlord which provides them the right of occupancy. There is what we  call a shorthold agreement or assured shorthold agreement. It is defined as one of the most common type of agreement that is used by the landlords in order to let tenants rent a residential property. Mostly, this type of agreement is given for only a period of six months. However, it can also be given for much longer. After the agreed period, the landlord may evict the tenant even without having a valid or legal reason.

Shorthold tenancy agreements allow each landlords to make a rental agreement of a particular property to a tenant while still holding the right to repossess it at the end of the agreed term. This is such an essential document or contract because it can be used to minimize the risk of any disputes by having clear terms and conditions prior to the agreement. This agreement can be in fixed term or in periodic term. Fixed term usually falls between six to twelve months, while periodic term falls weekly or even monthly. There are some contracts that may contain a break clause that allows you to end the agreement by simply giving an early notice.

What You Need to Know About Shorthold Agreement

With regards to the agreement, the tenant has to know about the written statement of the terms, what the landlord should do, rent details, details about the end of the fixed term, and the details with regards to eviction.

  • Written Statement of Terms

If there would be a case where the landlord cannot provide a contract, the tenant may ask for a written statement about the terms of agreement. The landlord should include the following details: start date of the tenancy, rent payable, rent due date, rent review clause, and the length of the fixed term agreement. Also, ask the landlord about his or her name and complete address.

  • Rent Increase

Take note that the landlord cannot increase the rental payment unless the tenant agrees to it and if the contract contains a rent review clause which sets out when an increase of payment can happen, how much notice you will get, and the method for rent increase.

  • End of Fixed Term

When the contract is about to end, the tenant has various options to choose. If the tenant still wants to stay, he or she can either agree to the fixed term contract or just stay at home without even signing the new contract. If in case that the tenant wants to leave, he or she can actually move out and return the keys by the time the fixed term ends.

  • Eviction

The landlord still has to follow the procedures for eviction unless the tenant would agree to go. They must give you the notice first and then get a court order for the eviction.
