A sworn statement is a document that confirms facts for a legal proceeding. These facts can include generally anything. What Is the Difference between a Sworn Statement and an Affidavit?

As we mentioned above, sworn statements and affidavits can seem like they’re the same concept but with different words used to describe them. They are quite similar in many ways, but there are important differences.

An affidavit needs to be signed with the witness of a notary public. This confirms the eligibility of the affidavit to ensure there has been no foul play and that the person signing the sample affidavit is in the condition to. A sworn statement, however, is signed without the witness of a notary public.

Affidavits do have a few advantages over a simple signed statement:

  • The person who signed them is subjected to penalties if he lied.
  • The notary public is able to confirm that the person who signed the affidavit is not suffering from any condition that would disqualify him.
  • The notary public is able to confirm the identity of the person signing the affidavit.
