Developing new artists and talents is great for those talented individuals to showcase their music and artistry to the world. However, merely just making music alone won’t get them anywhere if they don’t have people who can help them market their music and brand their identity as artists to the public. That is the job of an artist-producer. An artist-producer is responsible to release the music of the artist, giving them an identity that they can base their brand on, and giving them gigs and other live performance opportunities to expose them to people. Before an artist will partner with a music producer, a contract must be signed between them to ensure that the whole arrangement is done legally and the rights of both parties will be protected. What is an Artist Producer Contract?

An artist-producer contract allows an artist to hire a producer to create a track or series of tracks for their record label. The label gives the producer a budget for recording (money for the studio and general expenses) as well as an advance. The advance is non-refundable but is fully recouped from the producer’s share of sales.

How to Make an Artist Producer Contract

1. Create the Title and Identify the Parties

Give the contract proposal a title like “Music Contract,” “Artist Recording Contract,” or “Music Publishing Contract” at the top of the first page. Put the artist’s name as well as the record label’s name on the contract’s first sentence.

2. Write the Clauses and Definition Section

The contract’s recitals go next. It explains the contract’s purpose. The next part is for terms definitions. This is to define some unusual terminology or jargon that the typical person may not understand.

3. Include the Contract Terms

This is where you go over the contract’s terms in detail. Providing an overcall album provision (extending the contract for the artist to continue recording their songs after their contract expires), exclusivity provision (artists must only be exclusive in your record label), and a non-compete clause.

4. Describe the Payment Policies and Procedures

Next, outline in detail any policies or procedures addressing both the artist and the record label’s payment. You can recognize the following details:

  • Cancellation policy by the artist
  • Who owns the recorded tracks
  • Distribution rights
  • Royalty rate

5. Finalize the Contract

In the last section of your contract is where you include the termination clause (explain how the contract can be terminated), the merger clause, and the information of all parties involved (including their name, address, contact numbers, and email address). Put signature lines below this section where the artist and the record label representative, and producers can sign.
