A notice is a form of communication that aims to notify the recipient of something they are involved in. We receive several types of notices on different occasions.  If your rent or lease is about to end, you’ll receive a notice of termination letter.  Employers receive resignation notice letters from employees who will be leaving their position in the company. Other examples include payment notice, renewal notice, and a notice of investigation, to name a few. It’s not every day that we receive a notice of investigation, so let’s find out what it is.

What Is a Notice of Investigation?

A notice of investigation is a written notice issued to an employee who is put under investigation before the actual investigation process begins. The notice will include instructions on what the employee must do, including the allegations against them, which made them a subject of the investigation. The employers also notify their employees of their opportunity to respond to the notice, any misconduct incurred, and if they are placed on leave while the investigation is ongoing.  If the allegations are about the employee’s misconduct, the concerned employee will receive a notice of disciplinary investigation, and the findings are documented in an investigation report.

How to Write a Notice of Investigation

Wondering how you can start your notice of investigation letter? If so, then you can check out these easy-to-follow steps to help you get started.

1. Samples and Templates Are Your Best Friend

The best way to get started is by teaching yourself about the notice of investigation. You’ll learn a lot from different notice of investigation letter and notice form samples. The easiest way to write your notice is through the use of notice templates and free notice form samples. Ready-made templates already have everything you need. You just have to fill in other relevant information to make a customized notice.

2. Know Your Elements

Note that a notice of investigation will only be effective when all the important elements are included in it. The notice should provide details of what is investigated, a formal request for an interview, the member/s of the organization who will conduct the investigation, the parties involved, an offer to provide support to all parties, reminders to keep the situation confidential, and consequences for breach in confidentiality.

3. Make Your Draft

Start writing a draft with the information that you have gathered. To make your content organized and complete, following a specific outline would be of great help.

4. Write in a Bias-Free Manner

Your notice should not accuse any of the involved parties. Also, you should not write a biased conclusion about the investigation. Remember to keep your content professional at all times.

5. Send to the Parties Involved

Finally, send the notice to the parties involved before the investigation starts. It is important that they are aware of the investigation before it commences—they have every right to know.

Can I get investigated without my knowledge?

Yes, you can be investigated without your knowledge. An individual who is deliberately investigated in secret or without their knowledge is said to be under covert monitoring. In this arrangement, you will not receive an employee notice of investigation before the monitoring is carried out. Because this type of monitoring is difficult to justify, employers should only use this type of monitoring during exceptional circumstances or if an employer’s suspicion on an employee’s criminal activity is genuine. When the investigation is complete, the monitoring should not continue.

How long will the investigation take?

No one can pinpoint the exact duration of an investigation. Many factors may affect an investigation, and that includes the gathering of data and other important pieces of information. Finding a strong piece of evidence does not mean that the investigation is about to end. There are also instances when an investigation is suspended or discontinued due to varying reasons.

Will I get notified once the investigation is complete?

It is the job of the investigator to notify the parties involved that the investigation is complete. Sometimes, the members of the investigating team will give you the notification. They will also inform you when the completed investigation is forwarded to the decision-making body.

What should I do if I’m under investigation?

If you’re under investigation, that means that you could be involved in the case being investigated. People who are under investigation are often the plaintiff, the defendant, or the witness in a case. What you must do is cooperate during the investigation process. Still, you must remember your rights under the law. All of the parties involved in the investigation are entitled to the same protection and rights.

Who conducts the investigation?

Professional or expert individuals from the police’s investigation department are the ones who conduct criminal investigations. However, the act of investigating is not limited to the police alone. Different individuals can also conduct investigations, depending on the situation. In the workplace, the manager, supervisor, Human Resources representative, etc., can conduct an investigation. You’ll receive a notice of workplace investigation before the investigation begins.

Being under investigation is never a good thing, regardless if you are guilty or not. It’s a very uncomfortable feeling that seems like you’ve been stripped of your privacy. What you can do is to cooperate, and at the same time, be vigilant about exercising your rights before, during, and after the investigation. You can learn more about a notice of investigation through the free samples provided above.
