A puppy sales contract is primarily used to outline the terms and conditions associated with the acts of selling and buying puppies. However, the use of the contract is not limited to the terms and condition of the sale. Below is a list of some of the other uses of a puppy sales contract.

  • The contract is used to provide specific details about the transaction, which includes the duties and responsibilities of both the buyer and the seller when it comes to caring for the puppy.
  • It binds both parties who are involved in the sale of puppy, which means that they are obliged to follow the terms and conditions of the agreement.
  • The definition of contract breaches and remedies are stated in the puppy sales contract.
  • The contract serves as proof that the agreement between both parties existed and took place. It can also be used as evidence in court proceedings or legal matters if needed.
  • It is used to put into writing the details that has been agreed upon by the seller and the buyer regarding the act of selling and buying the puppy.
  • It states the transfer of rights and ownership of a puppy from the seller to the buyer after everything in the contract has been executed.
  • The payment terms and conditions of the sale is also provided in the contract, like the amount or pricing, payment method, and other required fees.
  • Both seller and buyers are protected in the contract in terms of providing guarantee to the pedigree of the puppy because it includes details about the health screening, vaccinations, registration, and vet checks of the puppy. This is so that the buyer won’t accuse you of withholding information to them about the puppy and so that the seller cannot also ask for more money to the buyer.

Elements of a Valid Contract

In order for any contract to be considered valid, it must posses all of the elements of a valid contract. Without these elements, the validity of the contract is questionable which will ultimately make it invalid. Below are the elements that makes up a valid contract.

Offer and acceptance

A contract starts when one party makes the offer and the other party accepts it. So it can be said that without this element a contract will not exist.

Mutual consent of parties

There should be a meeting of the minds in a contractor what is call a consensus ad idem. This means that the parties involved must agree on the same thing about the contract.

Intention to create legal obligation

The intention to create a legal obligation refers to the intention of the parties involved to go to court if the any of them does not meet the promise they made in the contract or if they made any violations against the contract.

Free consent of parties

Joining or being part of the contract must nit be forced on any party. Consent must not be acquired because of coercion, fraud, undue influence, misrepresentation and mutual mistake of facts provided to the parties.

Competent parties

The criteria that makes a party competent to join or be part of a contract are:

  • Must be of legal age
  • Must have sound mind
  • Must not be disqualified by the law to join any contract

All of the three criteria must be met in order to determine that party as someone competent to join the contract.

Lawful object

For a contract to be lawful, the agreement formed should not be about something that goes against the law. This means that it should not be fraudulent, unlawful, immoral, and against public policy. If it is unlawful, then it cannot be enforceable by law.

Lawful consideration

In a contract, there should be something in return for something. If only one party is receiving from the other, then there is no lawful consideration to that. So if one party gives something, they should also receive something in return.

Not expressly declared void

The agreement should not be something has been declared by a country or state to be void. Examples of agreements that has been publicly declared as void are trade restraints, marriage and legal proceedings because they are not of public interest.

Possibility of Performance

The terms and conditions in the contract should be capable of being performed. If the promises in the contract are those that cannot be performed or done in real life, then the agreement will be considered a valid one.

Certain meaning

The agreement should not be vague or confusing and its meaning should be capable of made certain.

Legal formalities

The contract should follow statutory requirements in order to make it valid. For example if the contract needs to be in writing, then it should be done in writing. Otherwise, it should not be enforceable by law.

If any of these elements is missing, then the contract cannot be considered valid. A puppy sales contract should include all of these elements for it to be considered as a valid contract. Using a valid contract for your business would mean that you are conducting a reliable and legal business. This will give you an good image in the business industry.
