Most equestrian instructional facilities require their riders and even guests to sign equine release forms that limit or prevent the business from liability in case an accident happens. This is aimed to let riders and guests be aware that they may not be able to sue and that by signing the release form in case they do sue, the provisions with which they signed the equine release form will nullify their filing of the case.

However, based on legal advice pooled from various sources, equestrian facilities are not bound to be totally liability-free in case of injury or death connected to horse-related activities. In the Unites States, most states have Equine Activity Statutes wherein instructors, barn camps, stables, and horse providers are protected from impractical lawsuits arising from horse accidents that is found to be unavoidable. This statute provides that an individual may not file a lawsuit if the accident arose from the result of an inherent risk of an equine activity. Nonetheless, it does not mean that just because the statute exists, an equestrian facility will be totally free from liability. The facility will still be liable for negligence and willful misconduct if they are proven to be negligent in reminding students and guests of the dangers of horse-related activities. For one, the statute mandates that equestrian facilities must provide notices and include such notices in their contracts that students and guests need to sign. Such notices warn of the risk of injury or death in participating in equine activities due to inherent risks in participation of such programs or events.
